FINDING OF EMERGENCY

The Board of Nursing finds that an emergency exists and that the attached regulation is necessary for the immediate preservation of the public peace, health, safety, or general welfare. The facts constituting the emergency include the following:

The restrictive nature of this regulation could negatively impact the health of the public by decreasing healthcare worker availability during this public health emergency cause by the COVID-19 pandemic.

ORDER CERTIFYING ADOPTION

I certify that the Board of Nursing, under the authority of AS 08.01.100, AS 08.68.100, AS 08.68.331, and AS 08.68.336, adopted at its March 20, 2020 teleconference meeting the attached one page of regulation changes as an emergency regulation to take effect immediately upon filing by the lieutenant governor, as provided in AS 44.62.180(3).

This action is not expected to require an increased appropriation.

TELECONFERENCE MEETING MINUTES March 20, 2020

By authority of AS 08.01.070(2) and in compliance with the professions of AS 44.62, Article 6, a meeting of the Board of Nursing was held by teleconference in the Atwood Building, Suite 1550 Conference Room, in Anchorage, Alaska.

March 20, 2020

CALL TO ORDER

Chair Danette Schloeder, called the meeting to order at 2:02 ROLL CALL

Those present, constituting a quorum were;

• Public Member: Shannon Connelly, Palmer

• APRN Member: Wendy Monrad, APRN, RN, Anchorage

On a motion made by Wendy Monrad seconded by Shannon Connelly and carried with 4 ayes, it was

RESOLVED that the Board of Nursing finds that an emergency exists under AS 44.62.250 and that an emergency regulation change is necessary to 12 AAC 44.815 for the immediate preservation of public health, safety and welfare. I MOVE that the Alaska BON revise the wording in 12 AAC 44.815. ISSUANCE AND RENEWAL OF CERTIFICATION, (a) An initial nurse aide certification is valid for the remainder of the current biennial certification period. A nurse aide certification must be renewed biennially on or before a date set by the department. The BON intends on making these regulations permanent.

On a motion to adjourn made by Wendy Monrad and seconded by Catherine Hample and rejected with 4 nays the Board of Nursing did not adjourn.

On a motion made by Wendy Monrad seconded by Catherine Hample and carried with 4 ayes, it was RESOLVED to adopt the wording stated in the previous motion.

On a motion made by Wendy Monrad and seconded by Catherine Hample and carried with 4 ayes the Board of Nursing adjourned at 2:23pm

Chapter 44. Board of Nursing.

12 AAC 44.815(a) is amended to read:

(a) An initial nurse aide certification is valid for the remainder of the current biennial certification period. A nurse aide certification must be renewed biennially on or before a date set by the departmentMARCH 31 OF EVEN-NUMBERED YEARS. A renewal reminder will be mailed to each currently certified nurse aide at least 60 days before the renewal date. A certification that is not renewed lapses.
